Beta Terms

1. What These Terms Are
These Beta Terms apply to beta, pilot, or evaluation access that Archive designates as such and provides without charge ("evaluation access"), and to Reports Archive provides without charge under it. An Account Archive opens for evaluation without charge has evaluation access until Archive tells you otherwise. These Beta Terms supplement Archive's Terms of Service, and where they conflict with it, these Beta Terms control for that access and those Reports. These Beta Terms never apply to a Report you pay for: a paid Order is governed by the Terms of Service alone. Terms defined in the Terms of Service have the same meaning here. Evaluation access, like all access to Archive, is by request and approval (Terms of Service §1).
2. Evaluation Only; Access May Be Revoked
Evaluation access is granted for evaluation and feedback. It is personal to the invited user and to the organization identified in the invitation, and it is revocable. Archive may modify, suspend, or end evaluation access, or the beta program, at any time and for any reason, with or without notice.
3. Pre-Release Software — Heightened AS-IS
THE SERVICE AS PROVIDED UNDER EVALUATION ACCESS IS PRE-RELEASE AND IS PROVIDED "AS IS," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. Features may be incomplete, may behave unexpectedly, may change substantially, and may be removed entirely. Performance, availability, and output quality during evaluation are not indicative of the generally available Service. All disclaimers and limitations in the Terms of Service apply with full force, and this Section adds to them.
4. No Service Level, No Support Commitment
There is no service-level agreement for evaluation access and no uptime, availability, or response-time commitment. Archive may provide support as a courtesy, but is not obligated to. Maintenance may occur without notice.
5. Evaluation Access Is Not a System of Record
Do not treat evaluation access as a system of record. Data, configurations, and Reports created under it (other than Reports you pay for) may be modified, corrupted, reset, or deleted, including when we migrate the platform or reset the environment, and we may do so without notice and without an obligation to restore. Keep your own copies of anything you need. This is a data-loss disclaimer, and it is a real one: plan accordingly.
6. Reports Provided Under Evaluation Access
Reports provided without charge under evaluation access carry all of the disclaimers in Section 11 of the Terms of Service — they are informational research products, they are not title opinions, title commitments, title insurance, or certified abstracts, and they are not legal advice. In addition, and specifically because they are provided for evaluation: they must not be relied upon in a live transaction. Do not use one as the basis for an acquisition, a lease, a drilling decision, a division order, a payment, or any filing or representation to a third party. If you need a Report you can act on, place a paid Order, which the Terms of Service alone govern, or tell us and we will discuss what is appropriate.
7. Fees
No fees are payable for evaluation access itself or for Reports Archive provides without charge under it. If you place a paid Order for a Report through the application, that Order is charged at the posted price and is governed by the Terms of Service alone; nothing in these Beta Terms makes a paid Order free, and nothing in them obligates you to place one.
8. Feedback
We want your feedback, and we want to be able to act on it. If you give Archive suggestions, comments, bug reports, feature requests, or other feedback about the Service, you grant Archive a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and incorporate that feedback into its products and services, without any obligation to compensate, credit, or account to you. You are not required to give feedback, and you should not send us anything you are not free to share.
9. Confidentiality of Pre-Release Features
Non-public features, screens, roadmaps, and performance characteristics of the Service that you see under evaluation access are Archive's Confidential Information under Section 14 of the Terms of Service. Do not publish screenshots, benchmarks, or descriptions of non-public functionality without our written permission. This does not restrict you from discussing your own experience with your own advisors under confidentiality, or from any disclosure required by law.
10. Ending Evaluation Access; Contact
You may end your evaluation access at any time by telling us or, where Section 16 of the Terms of Service permits, closing your account. When evaluation access ends — for you or generally — Archive may end your access or, if it tells you so, continue your Account without the evaluation designation; from then on these Beta Terms no longer apply to your Account (they continue to apply to Reports provided without charge under evaluation access), and you are charged only for Orders you choose to place at the published prices.
